If a migrant worker is not a citizen of an EU country, he must obtain the appropriate permit to work in Poland. The permit is issued by the voivode of the employer's location. The application for a permit is submitted by the employer. There are several types of permissions.

  1. Type A - provides for work under an employment contract with an employer in Poland. Conditions to be met:
  • The salary of the hired employee should not be lower than that of others occupying a similar position.
  • There was no candidate for the vacancy among the registered unemployed. Compliance with this condition is not required for: graduates of universities in Poland/EU countries who completed their studies within the previous three years; staying legally in the country for the previous three years; family members, employees of diplomatic and consular missions; applicants for a profession that does not require labor market testing, confirmation that it is impossible to fill this vacancy

  • employ a Polish/EU citizen;
  • representatives of foreign companies;
  • citizens of countries bordering Poland, or countries that have an agreement with Poland on labor migration, who arrived for guardianship or domestic help. Persons who previously held the position for which they are applying, but no more than three months ago;

  • doctors, dentists who arrived for internships and participation in programs in their specialty.
  • Type B - for employees who are on the board of an enterprise located in the country, for a period of up to 6 months a year. The conditions for issuing a permit are:
    • monthly income the enterprise where the foreigner plans to work as a member of the board has, over the past year, amounted to an amount not less than the average monthly salary in Poland;
    • the company employs at least two employees who do not require a work permit;

  • Type C - for foreigners posted to the country who have a permanent job outside Poland, for a period of up to 30 days.
  • Type D - for foreign employees of enterprises that do not have branches in Poland, sent to the country to perform work of a temporary and casual nature (export services).
  • Type E - for foreigners employed by a foreign employer and delegated to Poland for a purpose different from the situation for types B-D. To obtain permission you must:
    • working conditions complied with the Polish Labor Code;
    • a foreigner’s salary, even if it is less than the national average, will be no more than 30%;
    • the employer presented an employee who has a package of necessary documents and meets the requirements described above, who will represent the interests of the company before the voivode if the duration of the business trip is more than 30 days.
    • An application to extend a work permit is submitted by the employer no later than one month before the expiration of the current permit.

      The application for extension must be accompanied by:

      • a package of documents for obtaining a work permit, if the circumstances that served as the reason for issuing the previous permit have changed;
      • certificate of payment of stamp duty;
      • the employment contract under which the previous permit was issued.

      Who does not need a work permit

      To implement labor activity The following categories of migrants do not require permission:

      • persons who have refugee status or receive subsidiary protection in the country;
      • persons with a permanent residence permit, a long-term resident of the EU, who have a permit for acceptable stay in the country;
      • persons with a temporary residence permit who are married to a Polish citizen or a foreigner, whose status is determined by one of the above points;
      • EU and EEA citizens; persons who have become victims of human trafficking;
      • holders of a valid Pole Card;
      • persons who timely submitted an application for extension of a temporary residence permit, if immediately before that they had the right to work without a permit;
      • persons who are in the country to conduct training and participate in internships or international programs;
      • artists and researchers for up to 30 days, students and graduates of Polish universities;
      • correspondents, clergy, military personnel, athletes.

      A work permit is not required for workers employed abroad who arrive in the country to carry out installation, maintenance, and repair of imported equipment manufactured by their employer for a period of up to 3 months.

      New rules

      To reduce the number of abuses, the Polish authorities decided to change the conditions of employment. Thus, a seasonal work permit in the tourism and agricultural industries will be issued only in cases where the employer can prove that Polish workers do not want to work in the place offered to them.

      Short-term permits of up to 9 months will be available to those interested, but only companies that have existed for at least a year will be able to issue foreign workers. On the one hand, this protects Ukrainian workers. On the other hand, it strengthens control over the labor market. In the summer of 2018, Ukrainians will work according to the old rules.

      On June 22, the Polish Sejm adopted a bill providing for new rules for the employment of foreign citizens, in particular Ukrainians, reports Polish Radio. The solutions proposed in the law concern foreigners performing long-term work in Poland.

      We are talking about citizens of Armenia, Belarus, Georgia, Moldova, Ukraine, Russia, who will be able to use a simplified procedure for accessing the Polish labor market. This bill “On the promotion of employment and labor market institutions” provides for the introduction of a payment of 30 zlotys (205.5 UAH) for registering an employer’s statement of intent to hire a foreigner.

      The document provides for the introduction of seasonal work permits, which are issued for a period of eight months within calendar year now there will be an elder (head of the powiat - administrative unit second level). Currently, work permits for a period of 3 years are issued by the Polish voivode (the head of the voivodeship - the largest administrative unit in Poland).

      According to the law, an application may not be registered if the management concludes that it will be used for personal gain or for needs other than performing work.

      IN explanatory note The bill states that its adoption should reduce abuses and ensure financial revenues used by the elders to perform relevant tasks. This will allow local labor departments to effectively serve stakeholders.

      The new rules for foreign workers and their employers will entail new requirements:
