How they sell beer. Requirements for the place of sale. How much does a license for the retail sale of draft beer cost, what is needed for this?

Turnover of alcoholic products in the territory Russian Federation- a legislative issue. So, back in 1995, to regulate it, the authorities adopted the appropriate federal law, which is still valid today (naturally, taking into account some changes and additions). What does this legislative act imply? Do you need a license to sell beer today? What measures does the absence of this document entail? For these and others, no less interesting questions You can find the answers while reading the materials in this article.

Requirement for a license

Before considering the question of whether a license is needed to sell beer, it would be advisable to find out which types of product are in one way or another subject to the licensing procedure by the relevant government agencies. So, if the product contains less than fifteen percent ethyl alcohol, then a license certificate is not required. This means that such a product, in accordance with the law, is allowed to be sold on a general basis (the same as goods of other categories).

However, the manufacturer should be aware that the federal law mentioned above classifies products containing alcohol into food grade and non-food grade. Thus, along with almost all non-food products, beer products do not require a licensing procedure for their sale. This means that a license to sell beer is not needed except for certain cases described in the next chapter.

Exceptions

As it turned out, there are exception cases when licensing entrepreneurial activity for the sale of beer products is mandatory. In accordance with regulatory requirements, today there are two fundamental conditions in the beer trade process. Firstly, the area of the premises where the product is sold can in no case exceed fifty square meters.

In addition, an additional requirement, which differs according to different regions, is the proximity of the retail outlet to children's, school, preschool, and sports facilities. Secondly, a license to sell draft beer is necessary and mandatory if the ethyl alcohol content in the product exceeds sixteen percent.

Important nuances

In addition to the above restrictions, it should be noted that the sale of beer products that are subject to licensing is in one way or another classified into retail and wholesale. The first is suitable for bars, cafes, catering establishments, shops and restaurants. IN in this case the cost of a license is 65,000 rubles per year.

The second presupposes the presence of additional requirements for warehouse premises, the area of which is sufficient to carry out business activities of this type and with the appropriate technical characteristics. In addition, the cost permit document(licenses) in this case are slightly higher.

Current requirements

How to get a license to sell beer? To carry out licensed business activities, you must be guided by a number of requirements. Thus, in accordance with the above Federal Law and the Licensing Regulations, which were developed at the regional level, both Russian and foreign structures have the right to obtain a permit for the sale of beer products whose ethyl alcohol content exceeds sixteen percent, regardless of the form property.

A license to sell beer is issued only for a minimum amount authorized capital 10,000 rubles (1,000,000 rubles in Moscow), if it comes to retail trade. 10,000,000 rubles are required if we are talking about wholesale sales of beer products.

Current documentation

A license to sell beer is granted after a number of procedures have been completed. First you need to collect the documentation below:

  • A package of copies of the statutory documentation (the decision directly on creation, the final version of the Charter, state registration, document on registration in tax authorities, paper on the ownership of the premises, sanitary conclusion).
  • A copy of the floor plan.
  • A copy of the lease agreement for the facility (shop, restaurant, bar).
  • A copy of the fire safety inspection report.
  • A copy of the agreement confirming the availability maintenance alarms.
  • Copy state registration in relation to a cash register.
  • Original confirmation that the premises fully complies with fire safety standards.
  • The original document confirming that the business owner has no tax debts.

Do you need a license to sell beer - 2017?

As it turned out, in certain cases, licensing activities for the sale of beer products is a mandatory procedure. How to get a permit in 2017?

It should be noted that the current year for entrepreneurs in this niche has turned out to be quite revolutionary, because the requirements that apply to a candidate for a license agreement have changed in many ways. Today the license to sell beer is issued Federal service Russian alcohol regulation (Rosalkogolregulirovanie).

Variety of services

In order to somewhat simplify the difficult fate of entrepreneurs involved in the sale of alcoholic beverages, private intermediary companies have entered the market. The thing is that they received licenses to provide services for obtaining license certificates for the sale of beer and other alcoholic products, both for individuals and legal entities. Thus, these structures assist their own clients and help them obtain the documentation in question. In connection with these innovations, receiving all necessary documents for the sale of the products in question has been significantly simplified.

More information

It is important to note that the application for the right to sell beer, the alcohol content of which exceeds sixteen percent, is submitted directly to the department for the development of trade and entrepreneurship at the place of registration (and residence) of the business entity. The permitting document itself has the right to be issued strictly by Rosalkogolregulirovanie. It should be added that no more than thirty calendar days should pass between completing the application and receiving the license certificate.

Selling beer without a license

As it turned out, the rules for licensing activities for the sale of beer products for the most part assume that it is possible to do without a permit. However, if the beer contains more than sixteen percent ethyl alcohol, a license becomes necessary. It is important to note that failure to comply or improper implementation this requirement one way or another entails not only large administrative fines, but also criminal prosecution in certain situations. That's why this question should be taken very seriously.

In addition, you need to know that any alcoholic products, including beer, that are sold through retail must have the following information:

  • Product name.
  • Information directly about the manufacturer.
  • The presence of some additives (for example, flavoring).
  • Presence of contraindications.
  • Date of manufacture.
  • Best before date.
  • Warning that alcohol is harmful to public health.

In conclusion, it should be noted that in most cases a licensing agreement is not necessary when carrying out business activities to sell beer products or beer directly. However, there is an exception, according to which a product is subject to licensing, the content of which is distinguished by the presence of ethyl alcohol of more than sixteen percent (today there is a minimum amount of this product on the market).

In addition, the sale of beer and other beer products, as well as the sale of alcohol in other categories, in any case requires the unconditional fulfillment of a number of requirements. Failure to comply with them, as a rule, entails large administrative fines. In addition, it happens that an illegal entrepreneur is subject to criminal prosecution by the relevant government agencies and, accordingly, further arrest.

We hasten to please entrepreneurs planning to open a beer store: a license is not required to sell draft and bottled beer. Only strong alcohol (above 16%) is subject to mandatory licensing. For beer and drinks based on it: cider, poire, mead, etc. this requirement does not apply.

The rules for the sale of beer are regulated by Article 18 of Federal Law No. 171-FZ. It is there that the “types of activities subject to licensing” are described.

The document is submitted to the local branch of Rosalkogolregulirovanie. The declaration can be submitted electronically. Special software will facilitate the process of filling out the declaration.

Fire requirements for a draft beer store: what to check before signing a lease

The requirements of the Fire Inspectorate do not differ from the requirements for other retail outlets. If you rent a premises, then the landlord is responsible to the fire department. Before signing a store lease agreement, make sure that the premises meet the established standards:

By complying with the above requirements, you will be able to run a business selling draft beer and not break the law. If you want to bypass the difficult period of paperwork and get started faster, pay attention to ready business. When purchasing a beer store operating in St. Petersburg, check whether the owner has all the necessary documents.

If you are interested in offers in other cities, Altera Invest will help you. We have stores selling draft beer in Moscow. As well as a database of beer stores that are sold throughout Russia.

Since the summer of 2017, deputies plan to introduce a ban on the sale of individual entrepreneurs’ beer. The Ministry of Finance has already prepared a bill prohibiting private traders from selling foamy drinks, cider, buza and mead. Only legal entities will be allowed to sell them to the end consumer.

Let's share a beer!

From July 1, 2017, new rules for beer trade may come into force in Russia - only beer sales will be allowed legal entities, and this despite the fact that on at the moment out of 90 thousand retail outlets 90% of the foam drink trade is registered to individual entrepreneurs. In Crimea and Sevastopol, new standards may come into force in January 2018.

Retail trade in individual entrepreneur beer in 2017 may be limited for one reason. As the authors of the bill explained, small businessmen very actively hide real sales volumes, including because the fines for violations are too generous:

if a legal entity can pay a fine of 150-200 thousand rubles for failure to submit a declaration,

then individual entrepreneur is only 10-15 thousand.

IN explanatory note The bill contains statistics that confirm that individual breweries declared in 2015 several times less products than were sold at retail.

The current law on beer trade for individual entrepreneurs and enterprises of other forms of ownership obliges, from July 2016, regardless of the form of ownership, organizations selling beer to provide sales data to the Unified State Automated Information System, so many businessmen consider additional declaration to be an unnecessary waste of time and effort. The deputies do not agree, therefore, in addition to the planned ban for individual entrepreneurs, they want to tighten the sales rules and introduce another type of labeling for alcohol-containing drinks. The corresponding bill has already been posted on the regulatory legal acts portal for public discussion.

Experts fear that the innovations will hit businesses that specialize exclusively in selling low-alcohol drinks, including breweries that produce “live” beer in small volumes, the hardest. In addition, traditional schemes that Russian entrepreneurs use in cases of bans are not excluded - most simply go into the shadows, as a result of which arrears to the budget increase.

Alcohol online

Sociological studies by RANEPA, Rosstat and the Institute of Social Analysis and Forecasting have shown that in recent years in Russia there has been a trend of shifting preferences of Russians - against the backdrop of a growing refusal of alcohol, people more often choose not strong drinks (vodka, cognac), but beer or wine.

Statistics. In 2007-2009 Russians consumed 32% of beer from total retail alcohol sales. In 2015 – already 43%.

Experts are convinced: even if “the screws are tightened too tightly” and it becomes difficult to buy beer in a regular store, there will always be an opportunity to purchase what you need in another way. For example, via the Internet, because it’s no secret that even with the current ban on the sale of alcohol at night, you can buy it online at any time, in any quantity and with home delivery.

Trying to restore order in this area, deputies propose to legalize the sale of alcohol online by selling a special license, which will give the right to both individual entrepreneurs and legal entities to sell alcoholic beverages via the Internet legally. To do this you will need to buy:

    license for retail trade(preliminary cost 80 thousand per year);

    license for wholesale trade(800 thousand rubles/year);

patent for alcohol production – 9.5 million rubles.

Stores with licenses will be included in a special register. The rest will be identified, punished, and closed. How this will look in practice is still unknown, although judging by the actions of casinos and other resources whose activities are limited in Russia, it is not difficult to recreate the picture. Today one illegal store is closing, tomorrow two new ones will open in its place.

Whether trade in individual entrepreneur beer will be banned at the height of the next season or not, time will tell. Ordinary consumers can only hope that innovations in once again will not affect their wallet.

The draft beer store is quite successful and profitable business, which is built on the constant high demand of this drink. For example, in the European part of the country, the annual growth of the “beer” market increases by 8-13%.

To organize the work of the store is not required large sum money, and the high payback of this business can justify itself in as soon as possible. But, despite all the positive aspects of this business idea, there are various nuances that must be taken into account during implementation.

Is this destination seasonal?

Sales of beer on tap are considered seasonal business, whose revenue is approximately 40% higher during the season. Most stores are open during the cold season only to cover operating expenses.

In exceptional cases, profitability drops so much that it is more advisable to close the store during the cold weather.

What you need to sell beer: documents and licenses

Before starting their own business, future entrepreneurs need to carefully study legislative framework, which regulates the retail trade of low-alcohol drinks.

Adopted on July 18, 2011 Federal Law No. 218, tightening requirements for the sale of alcoholic beverages. Based on this law, it became strictly prohibited to trade it in educational institutions, markets, transport or at its stops, stations, non-stationary shopping facilities and medical institutions.

But now both organizations and individual entrepreneurs have the right to sell beer.

On January 1, 2013, a law was passed tightening the previous trading rules - from now on, beer can only be sold at certain times: from 8 a.m. to 10 p.m. Sales in kiosks or stalls have become strictly prohibited.

Form of enterprise

The future businessman faces a choice of organizational and legal form, mainly this choice between individual entrepreneur and LLC. The latter will be the most profitable - new laws are increasingly tightening the requirements for individual entrepreneurs involved in the sale of low-alcohol products. For example, they are now required to declare and record the volume of retail sales. In any case, the LLC maintains declarations and records, but a more simplified taxation system has been introduced for them due to the savings in several taxes: property tax and enterprise profit tax, VAT.

To open a beer store you will need the following:

  • Register an LLC (or individual entrepreneur).
  • Conclude a purchase/sale or lease agreement for the premises where the store will be located in the future.
  • Complete the registration and contract for servicing the cash register.
  • Obtain permission to carry out trading activities in the local Administration.
  • Obtain conclusions from inspection organizations.
  • Conclude employment contract with store employees and issue them health certificates.

Choosing a store location

When opening a store, you need to choose the right premises - future sales volumes depend on this. The most the right choice will be densely populated residential area– there is a high probability that it will be local residents who will form a constant flow of clients.

Also advantageous is the proximity to the market, location on a street with heavy traffic flow, various shopping and entertainment centers - all this will allow beer lovers passing by to purchase a drink.

The total area of an average-sized store is approximately 50 sq meters– all this is required for the efficient and compact installation of a bar, bottling equipment and a customer service area. There must be a toilet in the store

The future premises should be comfortable for customers. The display window must be installed so that even with a large influx of customers it is clearly visible.

During the interior arrangement of the store, do not forget about the requirements of the regulatory authorities - firefighters and SES - they pay increased attention to the store:

  • SES - due to the presence in the assortment of foods and drinks that require special storage conditions.
  • Firefighters - due to the presence of special equipment in the room, namely gas cylinders, which explode if used incorrectly.

By law, it is prohibited to locate stores that include alcohol in their assortment near various child care institutions.

Therefore, when choosing a room, it is important to take into account a number of mandatory factors, and if the chosen location does not fully correspond necessary requirements, then you need to look for something else. In practice, this can take up to six months.

Organization of supplies and storage

The next stage is the search for suppliers, optimization and selection of assortment. The most optimal at the start is cooperation with wholesale suppliers of various types of beer, which provides a flexible option for managing purchases: selecting the required volume of arbitrary types of beer in the shortest possible time. The downside is the price, which is significantly higher than that of the manufacturer, to order from which you need to have a fairly large turnover, equivalent to about six stores.

When it comes to choosing equipment from a manufacturer, the opinions of businessmen differ strikingly:

  • some say that by renting equipment, you can save a lot and use the remaining funds for the development of the project;
  • others argue that it is necessary to purchase its own bottling line, because in the first six months the new store needs to optimize the assortment for local customers.

When large stores open, at least 25 beer taps (types of drink) are installed. But most entrepreneurs claim that after a year of work, the assortment is reduced to 15 items: unclaimed varieties gradually begin to reduce profits, and are eventually abandoned. But, nevertheless, in a large store it is advisable to stock more than 20 types of beer.

Do not forget that the higher the assortment in the opened store, the faster the optimization of supplies will take place. And bottling equipment is quite unreliable in maintenance and operation, so it is recommended to have a couple of spare lines.

Delivery optimization is required due to the fact that fresh beer must be sold within 3 days if possible. After this period, the drink begins to gradually lose its taste properties; after 5, it can no longer be consumed.

Markups for draft beer depend on the price category and usually amount to from 50 to 100%. The average price of fresh beer fluctuates around 130 rubles per liter. Preferences local residents It is quite difficult to predict the cost. But don’t forget that when going to a beer store, customers are willing to overpay a reasonable price for their preferred type of drink.

Do you need advertising?

When promoting a draft beer store, various types of advertising are not always effective, and many types of advertising are quite expensive. Despite the high price of the media, the results from them are reduced to zero.

Therefore, you need to approach with special care for exterior decoration, outdoor and regional advertising- This is the most common way to notify the public about a future opening.

Outdoor advertising includes thematic design of the shop window and facade, an original name that sticks in the memory, sound advertising that periodically announces to passers-by about the ongoing promotion, good lighting at night. Before the opening and in the first months of operation, it is advisable to conduct an advertising campaign - as an option, distribute discount cards to residents.

How much does it cost and how quickly will it pay for itself?

During the summer maximum revenue is around 300 thousand rubles, and if the business was opened from scratch, then it Payback usually occurs within a couple of months.

During the week, sales volumes fluctuate - at first they fall, and starting on Friday they increase. This must be taken into account when purchasing goods.

For quick payback The best time to open a store is early summer. Also, along with draft beer, it is profitable to sell bottled beer with a decent assortment of snacks.

Initial Investment

The required amount to open this business in different regions ranges from 150 thousand rubles. up to 1 million rubles

The list of required expenses for opening a medium-sized store looks something like this:

  • Rent of premises for a couple of months – from 1000 rubles. per square meter.
  • Repairs and related finishing – up to 100 thousand rubles.
  • Pavement sign, sign, etc. – from 20 thousand rubles.
  • Stand (made to order) ~ 20 thousand rubles.
  • Refrigerator display case ~ 20 thousand rubles.
  • Air conditioning ~ 20 thousand rubles.
  • Cash register ~ 20 thousand rubles.
  • Wages service personnel~ 15 thousand rubles. person.
  • Defoamers, beer kegs - can be purchased from suppliers.
  • Various office supplies, packaging bags, communications, etc. ~ 5 thousand rubles.
  • Purchase of the first batch of beer ~ 50 thousand rubles.

Free equipment is often provided by large suppliers.

Business pitfalls

With such costs, to run a business without loss, monthly revenue must be at least 40 thousand rubles. Solid profit at the level of this indicator with optimistic forecasts achieved after 4 months from the start of the store’s operation.

The most important issues are choosing a legal form, working with suppliers and setting up a store, and resolving issues with documentation.

All other issues and actions to promote, develop and improve the store’s activities are part of a business plan that meets modern market requirements.

For the comfortable functioning of the store, it is advisable to hire two sales assistants working in shifts, a cleaner, and sometimes a security guard is required. Some functions can be performed by sellers themselves. The store owner usually does the bookkeeping. The seller’s responsibilities also include monitoring the quality of beer, the cleanliness of equipment, containers, premises and the surrounding area.

What business will bring good profit in 2018? Already several recent years Demand for draft beer is growing. Therefore, opening a beer store or bar will be a very profitable business.

Now beer in regular stores costs a little less than in pubs and bars. But the quality often varies greatly. In a regular store you can buy a bottle that has been on the counter for 3 months and the drink is even disgusting to drink. But in beer stores you can buy a fresh and tasty drink for almost the same price. Therefore, beer shops and bars are becoming increasingly popular among the population.

Naturally, businessmen also noticed this and they understood where to invest money in 2018, namely, to open their own cozy establishment for selling beer, and they can count on a good profit.

Opening a beer store from scratch

To begin with, it is worth deciding on the organizational and legal form. As a rule, most businessmen choose individual entrepreneurs. But the laws have tightened the requirements for individual entrepreneurs who sell beer. In other words, it is now necessary to maintain mandatory records and declarations of retail sales volumes.

The following codes are suitable for opening a beer store: OKVED OK 029-2014 (NACE rev. 2):

  • 47.25.12 (main) - Retail trade of beer in specialized stores.
  • 47.2 - Retail trade food products, drinks and tobacco products in specialized stores.

Taxation of a beer store

You will also need to pay tax. Eat different types taxation, but experts recommend choosing the simplified tax system (“simplified tax system”) when you plan to open a store in Moscow. If we are talking about regions, then it is better to choose UTII - single tax on imputed income.

Moreover, deductions should be made to pension fund from the salary of each employee. But often beginning businessmen work independently. Those. they are the store director, salesperson, loader, cleaner. All rolled into one.

Maintaining accounting can be entrusted to an outsourcing company.

Profitability of a beer store

Of course, significant investments will be required to open it. This includes purchasing beer and snacks, renting premises, purchasing furniture and equipment, documentation, etc. But there is also a pleasant moment - profitability. For example, 1 liter of “Zhigulevsky” beer costs 56 rubles from the manufacturer, but in a store this liter can be sold for 120 rubles. In other words, the markup will be slightly more than 100%.

To open a business you will need approximately 500-600 thousand rubles. And the payback for a beer store can take 3-6 months if everything goes smoothly.

Please note

The figures are approximate. They may differ depending on the region, turnover size, room area, etc.

I will be happy to answer all questions in the comments to the article.
